Alcotest Results No Good in NJ DWI’s
Trooper Marc Dennis cases Invalidate 20,000 DWI Cases- 11/13/18 NJ Supreme Court said his failure to properly calibrate the Alcotest 2110 = 20,667 cases must be either retried or dismissed. The thermometer set forth in State v. Chun was not used and makes the DWI readings scientifically un-reliable or “raises substantial doubts about the scientific reliability of breath test results produced by Alcotest devices calibrated without use of a NIST-[National Institute of Science and Technology] traceable thermometer.” Dennis currently is under indictment for falsifying test results in Monmouth County.
